Terms of Use and Booking Conditions
Last updated: September 29, 2026
These terms govern the use of villaparadisetahiti.com and bookings made directly with Villa Paradise Tahiti.
Contracting operator: Thierry Havelange, trading under the name Villa Paradise Tahiti. Any agent acts on his behalf and does not replace him as the contracting party.
Address: Lot 5, Mata Miti, Temaruata, 98703 Punaauia, Tahiti, French Polynesia.
Email: villa.paradise.tahiti@gmail.com
1. Scope and contractual documents
These terms apply to direct bookings, subject to the applicable mandatory legal provisions.
Before booking, the guest can read these terms, the cancellation policy and the features of the chosen offer. Acceptance is obtained at the time of booking through an affirmative action, then restated in the confirmation, sent in a form that allows it to be kept.
Merely browsing the site does not, by itself, create a contract for a stay.
Any special conditions expressly agreed and stated in the confirmation prevail over these terms on the points they change.
For a booking made on Airbnb, Booking.com, Vrbo, Abritel or another platform, the terms accepted when making that booking apply. These terms do not retroactively change the payment, cancellation or guarantee arrangements agreed on the platform.
The privacy policy explains how personal data is processed; being informed of it does not amount to general consent to that processing.
2. Lead guest and booking
The lead guest must be at least 18 years old and have the legal capacity to make the booking.
The lead guest must provide accurate information about their identity, contact details, the number of guests and the services requested, and must be authorized to use the payment method presented.
The lead guest undertakes to pass on the house rules and safety instructions to the people traveling with them and to ensure they are followed. Each adult remains responsible for their own actions; minors remain under the supervision of the adults in charge of them.
The booking becomes firm once:
- the contractual documents have been accepted;
- the payment due has been received;
- Villa Paradise Tahiti has sent a written confirmation stating the dates, the occupants, the price and the agreed services.
An availability request or a quote is not a confirmed booking, unless otherwise agreed in writing.
3. Payment
Unless special conditions are stated before booking:
- a deposit of 30% of the total price is due at booking;
- the 70% balance is due 30 days before arrival;
- for a booking made less than 30 days before arrival, the total price is due at booking.
The deposit is a partial payment for the stay. The consequences of a cancellation are set out in the cancellation policy accepted at booking, subject to the applicable mandatory rules.
If a payment is missing, we send a formal written notice stating the amount due, the deadline to pay and the consequences of non-payment. This deadline takes into account how close the arrival date is. Termination is then notified in writing under the legally applicable conditions. Any compensation due is determined under the cancellation policy, with no double recovery for the same loss. No access to the property is arranged until the amounts due have been paid, subject to applicable mandatory rights.
Online payments are processed by the provider offered at the time of payment. Do not send your full card details by email or messaging.
4. Prices, currencies, taxes and promotions
4.1 Price and currency
The total price, the currency actually charged, taxes, mandatory fees and included services are shown before you confirm.
A conversion shown in another currency may be for information only. Exchange or bank fees charged separately by your bank or payment provider remain your responsibility.
The confirmed price cannot be increased unilaterally, except for a change you expressly accept or a tax change that may lawfully be passed on to the guest. Any tax change must be explained and justified.
4.2 Capacity and minimum stay
The rate corresponds to the villa configuration and the maximum number of occupants stated in the confirmation.
For the four-bedroom offer, maximum capacity is eight people, children included. Any other configuration or capacity only applies if it is expressly offered and confirmed.
The minimum stay depends on the dates selected. It is shown before booking, in particular when a seven-night minimum applies over the holiday season.
4.3 Long-stay discount
When this offer is available at the time of booking, stays of 14 nights or more receive a 10% discount on the subtotal of nightly rates and cleaning fees.
The discount does not apply to taxes, excursions or other optional services, unless expressly stated otherwise. It cannot be combined with another promotion, unless agreed in writing.
The discount amount and the final price appear in the summary accepted by the guest.
5. Included services and additional services
Only the services described in the offer and the confirmation are contractually included.
The photographs show the premises and their features. Minor changes to furniture or decoration may occur without substantially reducing the agreed service. Any significant change is brought to the guest's attention.
Airport transfers
Where the booked offer provides for it, airport transfers are included and handled by our partner taxis, subject to the arrangements and capacity specified before booking.
Flight times must be provided in advance. Any special service or change must be confirmed.
Vehicle provided
When a vehicle is included, its use is governed by a separate document setting out, in particular, authorized drivers, required licenses, insurance, deductibles, prohibited uses and return arrangements.
The words "vehicle included" do not mean that fuel, traffic fines, all deductibles or all damage are covered.
Outside providers
For excursions, meals and other outside services, you are informed of the provider's identity, the price and the applicable terms.
When we act only as an intermediary, this role is stated before you order. This does not remove any liability arising from our own commitments or faults.
6. Arrival, departure and length of occupancy
A welcome at any hour can be arranged, including for overnight flights, subject to prior written agreement.
The exact dates and times at which the property is made available and must be vacated are communicated and accepted before payment, then restated in the confirmation. The number of nights charged is specified. A night-time welcome does not guarantee early access to the property.
A very early arrival may require booking the previous night. A late departure may require an extra night or an expressly agreed supplement.
Any flexibility depends, in particular, on other bookings, cleaning and the availability of the premises. It must be confirmed in writing.
Times are expressed in Tahiti local time.
7. House rules
Guests undertake to:
- respect the capacity and the list of authorized occupants;
- not receive outside visitors without prior agreement;
- not hold parties, weddings or events without written permission;
- not smoke or vape indoors;
- not bring animals without written permission, subject to applicable mandatory provisions;
- respect the neighbors' peace and quiet, especially between 10 pm and 7 am;
- use the equipment for its intended purpose and in line with the instructions;
- not disable safety devices;
- promptly report any damage, breakdown or hazard;
- comply with local regulations and environmental guidelines.
Subletting, transferring a booking and commercial activities on the property require our prior written agreement.
In the event of a breach, we may ask for it to stop and be remedied. In the event of immediate danger or a serious breach, we may take the necessary measures and ask for the stay to end, in accordance with the applicable procedures.
Financial consequences are assessed according to the seriousness of the breach, the proven loss and the applicable rules. There is no automatic forfeiture of all amounts paid.
8. Safety: pool, hot tub, terraces and surroundings
Guests must read the instructions provided on arrival.
The pool, hot tubs and other equipment must not be used in dangerous conditions, in particular while intoxicated or without regard to the instructions.
Children and people who need assistance must be actively and appropriately supervised. Safety devices do not replace this supervision.
Equipment may be temporarily closed when maintenance, a weather alert or a risk justifies it. We inform guests and seek to limit the consequences of the closure, without prejudice to their legal rights.
Sea and outdoor activities carry specific risks and are subject to the instructions of the professionals who run them.
This section does not release Villa Paradise Tahiti from its safety, maintenance and information obligations.
9. Security deposit and damage
When a security deposit is required, it amounts to USD 2,000, unless special conditions are agreed before booking.
The deposit may take the form of a bank pre-authorization or another mechanism actually offered. Its nature, the date it is taken and its arrangements are communicated before booking.
A pre-authorization will only be announced if the payment provider actually supports it.
When no deduction is justified, we request the release of the pre-authorization or return the amount actually collected within seven business days of departure. If damage is identified, the guest receives within that period a reasoned notice stating the amount provisionally concerned and the supporting evidence available. The undisputed portion is returned. Final settlement takes place without undue delay once the amount is established, without prejudice to either party's remedies.
Damage attributable to guests, lost equipment or cleaning that objectively exceeds normal use may give rise to a claim for compensation.
Any claim is itemized and backed by appropriate evidence: dated photographs, check-in and check-out reports, quotes, invoices or other relevant documents. Normal wear and tear and pre-existing defects are not charged.
The assessment takes into account the prior condition, wear and age. Any loss of income claimed must be certain, justified and attributable to the damage, with no double compensation. No automatic penalty applies for a negative review or a complaint.
The guest is informed of the facts alleged and may respond. A deduction or charge is only made under a valid authorization and the applicable procedures; otherwise, payment is requested from the guest or pursued through legal channels.
The security deposit is not a cap on liability for proven damage of a higher amount.
10. Owner access and maintenance
Guests have exclusive use of the areas included in their booking.
Where there is an adjoining apartment occupied by the owners, with a separate entrance, this is stated in the offer when it is not part of the rented areas.
Any entry into the private areas is arranged with prior notice to the guest and, where necessary, their agreement. In a genuine emergency, in particular to protect people or prevent significant damage, access may take place to the extent strictly necessary.
Scheduled maintenance is organized so as to limit disruption.
11. Camera and privacy
The presence of the garage camera and the areas actually monitored are stated in the offer before booking and signposted on site. The specific notice about this system is provided before any access to the filmed area.
The notice states the security purpose, the legal basis for processing, the field of view, the periods of operation, whether footage is recorded and for how long, who is authorized to access it, any providers and data transfers involved, and the contact for exercising your rights. No device may monitor private spaces. Audio capture must be separately assessed for necessity and lawfulness.
The system must respect guests' privacy and the applicable rules. Informing the guest, or the guest's acceptance of these terms, does not amount to a waiver of their rights.
For platform bookings, that platform's own rules on cameras must also be followed.
12. Cancellations and changes
The cancellation policy provided before booking, and attached or linked to the confirmation, determines the applicable fees and refunds.
For the offer described in these terms, a cancellation received more than 60 days before arrival entitles the guest to a full refund of the amounts paid for the stay.
For a cancellation by the guest, fees are based on the total price of the nights after discounts: 0% more than 60 days out, 50% from 30 to 60 days inclusive, and 100% less than 30 days out or in the event of a no-show without prior cancellation. The calculation is made in 24-hour periods up to the agreed arrival time, in Tahiti time. Exceptions, rescheduling, refundable items and any balance still owed are set out in the cancellation policy. Statutory rights and the review of proportionality remain applicable.
Change requests are subject to availability and our written agreement. They may lead to a new rate, communicated before acceptance.
A transport delay or a personal change of plans does not automatically change the cancellation terms.
Travel insurance covering, in particular, cancellation, medical expenses, assistance and personal liability is recommended. Taking out insurance does not reduce our obligations.
13. Unavailability attributable to Villa Paradise Tahiti
If we cannot provide the booked accommodation for a reason attributable to us, we inform the guest as soon as possible.
We may offer an alternative, which the guest is free to accept. If no alternative is accepted, the amounts corresponding to the services not provided are refunded, without prejudice to any other rights the guest may have.
We cannot impose substantially different accommodation, or a credit, in place of a refund legally due.
14. Force majeure and exceptional events
An event is only treated as force majeure if it meets the criteria set by the applicable law. A disaster, an epidemic, a strike or a travel restriction is not automatically force majeure for every obligation under the contract.
The affected party informs the other as soon as possible and takes reasonable steps to limit the consequences.
Depending on the nature and duration of the impediment, obligations may be suspended or the contract terminated in accordance with the applicable rules. Amounts relating to services not performed are handled under those rules.
Rescheduling or a credit may be offered, but it only replaces a refund due with the guest's agreement or where an applicable text allows it.
A personal impediment on the guest's side, while the accommodation remains available and accessible, is in principle governed by the cancellation policy, subject to applicable mandatory provisions.
15. Liability
Each party is liable for the damage attributable to it under the conditions set by the applicable law.
Villa Paradise Tahiti is not liable for damage shown to result solely from the guest's wrongful conduct or from a cause that legally releases it from liability.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, in particular for personal injury caused by our fault or for a breach of an essential obligation.
The guest takes reasonable care of their personal belongings, uses the locks provided and promptly reports any loss or incident. The mere presence of an item in the villa does not mean it has been deposited with the operator. Any liability is assessed according to the circumstances and the applicable law, including any mandatory rules on innkeepers' liability. No general exclusion of liability for theft, loss or destruction is stipulated.
The guest is liable for proven damage caused by their fault. Claims concerning the people traveling with them or third parties are assessed according to the facts, their respective responsibilities and the applicable law.
Legal or attorney's fees are not automatically charged to the guest: they depend on a valid agreement or a decision of the competent authority.
16. Complaints
Any problem should be reported as soon as possible during the stay so that it can be addressed.
Complaints may be sent to villa.paradise.tahiti@gmail.com, stating the booking reference and the facts concerned.
Failing to report a problem immediately may make some checks or interventions more difficult, but does not amount to an automatic waiver of the guest's rights.
We seek an amicable solution. This process does not deprive either party of the right to refer the matter to a competent authority, nor does it automatically suspend legal time limits.
17. Use of the site and intellectual property
The site must be used lawfully. Intrusion attempts, identity theft, fraudulent bookings and any use likely to disrupt the services are prohibited.
Content is protected where it belongs to Villa Paradise Tahiti or is used with the permission of its owners. Any unauthorized commercial use or reproduction is prohibited, subject to legal exceptions.
Continuous availability of the site cannot be guaranteed. A technical outage does not affect a booking already confirmed or the obligations arising from it.
18. Governing law and jurisdiction
The contract is governed by the law applicable in French Polynesia.
This choice does not deprive the guest of the mandatory protections they are entitled to under the applicable rules of private international law.
Failing an amicable settlement, disputes fall under the courts determined by the applicable rules, including mandatory consumer protection rules.
These terms impose no mandatory arbitration in the United States and no general waiver of the right to go to court.
19. Language versions and evidence
The French and English versions must express the same commitments.
In the event of a discrepancy, the documents actually presented and accepted at booking, any agreed special conditions and the legal rules of interpretation are taken into account. No language precedence may deprive the consumer of their mandatory rights.
Confirmations, correspondence and electronic records may serve as evidence under the legal conditions. The guest may request a copy of the contractual documents for their booking.
These records are not conclusive evidence in the operator's favor. Each party may challenge them and provide other evidence. The versions of the documents, the date they were provided, the acceptance and the price summary are kept within the limits set by the privacy policy.
20. Changes to these terms
The version that applies to a booking is the one accepted when the booking was made.
New versions apply to later bookings. Changing an existing contract requires the agreement of the parties, unless a legal provision allows another mechanism.
If a clause is held unenforceable, the other provisions remain in force to the extent the contract can lawfully continue.
